These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.

This website is operated by¬†BelledeSoiree.¬†Throughout the site, the terms ‚Äúwe‚ÄĚ, ‚Äúus‚ÄĚ and ‚Äúour‚ÄĚ refer to¬†BelledeSoiree.¬†BelledeSoiree¬†offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

Our store is hosted on Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

We need your telephone number to contact you in case there is an issue with your order- we will not use it for anything else such as marketing purposes

And will never pass it onto a third party.

Service Availability

Our Site is intended for use by people residing in Europe and the rest of the world (Serviced Countries). We do accept orders or subscriptions from individuals part of the Serviced Countries.

Your Status

By placing an order through our site, you warrant that:

  • You are legally capable of entering into binding contracts;¬†
  • You are a resident¬†of a Serviced Country;¬†and
  • You are accessing our Site from a Serviced¬†Country.
  • You have read the general terms of sales and accept them

Ordering

Everyone is allowed one customer account, but you have to be 18 or over to do so. By placing an order on our website, you agree to give:

  • Your real name;
  • Your e-mail address;
  • Your billing address
  • A telephone number as stated above
  • A delivery address (this must be the same as your billing address);
  • A contact phone number (in case we need to speak to you about your order).

If the technology fails us or we make a genuine mistake, your order attempt may be unsuccessful. We will do everything we can to resolve this and aim to put that smile firmly back on your face. Once you have placed an order, you will receive a confirmation e-mail within 24 hours, and then one within 24 hours of your order being dispatched.

You do not need to worry as we will be with you every step of the way.

If something is not in stock, we will let you know as soon as possible after the order has been placed. If we are expecting the item in soon, we may send it in a separate parcel after your main order has been dispatched.

After placing your order, you will receive an automated acknowledgment.

Cancellations and Returns

We aim to dispatch orders within a few days as described above, so if you want to cancel an order without incurring a cost , as changing your mind can happen, you will need to do it before your order is dispatched- as soon as possible.

If you do cancel an order, please email us and let us know during office hours to contact@belledesoiree.com putting your full name and all details.

You have a legal right to cancel a contract which starts from the date we confirm your order has been dispatched, which is when the contract between us is formed.  

Are there any charges for return? No. 

  • The wrong size, wrong item, and quality problem items can be exchanged.
  • Original shipping charges are non-refundable
  • You are responsible for return shipping charges.
  • You MUST use trackable Mail and share the tracking number and link with us.

There are certain situations where only partial refunds are granted (if applicable)

  • Any item not in its original condition is damaged or missing parts for reasons not due to our error
  • Any item that is returned more than 14 days after delivery.

To be eligible for a return, your item must be unused and in the same condition that you have received it.

Additional non-returnable items

  • Personalized and Engraved items are non-refundable unless it is part¬†of¬†the product's design.
  • Design-your-own and custom made orders are not refundable, and non-cancellable
  • Gift Cards are not returnable
  • Clearance items are not refundable
  • Appraisals are non-refundable
  • Free gifts or Marketing Materials
  • Purchases made with either part of full Loyalty Points toward the cost of the product.
  • Downloadable software products
  • Some health and personal care items
  • Items on sale

To cancel a contract, please contact us first in writing to tell us by sending an email to contact@belledesoiree.com with the reasons for such decision. 

Please do not send back your purchase to the manufacturer. 

  • If the products have already been delivered to you, you have a period of fourteen days (14)¬† in which you may cancel, starting from the day¬†(Days mean calendar days, including weekends and public holidays)¬†after¬†the day you receive the products.¬†

You may wish to keep a copy of your cancellation notification for your own records.  If you send us your cancellation notice by email, then your cancellation is effective from the date you sent us the email. You need to inform us of your decision to cancel before the 14-day cancellation period has expired.   

  • Where you have canceled a contract and the products have already been delivered to you,¬†you should return them to us as soon as possible¬†with the proof of¬†sending¬†and in any event¬†no later than 14 days¬†after¬†the day you inform us of your right to cancel.¬†¬†

Refunds 

Upon receiving the package, our quality assurance team will review the item. Upon their approval, we will issue a refund within 7/14 business days in the original payment method. 

**Refunds will not be processed by wire transfers under any circumstances.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. 

Your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next, contact your bank. There is often some processing time before a refund is posted.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately, sale items cannot be refunded.

Exchanges (if applicable)

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at contact@belledesoiree.com and send your item to Belledesoiree 405 Kings Road, London SW10 OBB

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You can return products by sending them to our Returns Address below. Unless the products are faulty or not as described, you will be responsible for the cost of returning them to us.  You have a legal obligation to keep the products in your possession and to take reasonable care of the products while they are in your possession.

If you cancel a contract within the 14 day cancellation period, you will receive a full refund of the price you paid for the products.  You will not be refunded for any costs you have incurred for returning the products to us.  

Where the products have already been delivered to you, we will process the refund due to you as soon as possible and, in any case, within 14 calendar days after the day on which we receive the returned products, or (if earlier) within 14 calendar days after the day you provide us with evidence that the products were returned to us.  

  • Where the products have not been delivered to you,¬†we will process the refund within 14 calendar days¬†after¬†the day we were informed of your decision to cancel the contract.¬† We will refund you on the credit card or debit card used by you to pay for the products.

We have a legal duty to supply products that conform to the descriptions and specifications in the contract between you and us.  As a consumer, you will always have legal rights in relation to products that are faulty or not as described which are not affected by your cancellation rights above. If you have returned the products to us because they are faulty or misdescribed, we will refund the price of a defective product in full, any applicable delivery charges, and any reasonable costs you incur in returning the item to us.

In the event of a damaged parcel

We're very sorry if the Belledesoiree products you looked forward to receiving have arrived damaged. We do our best to pack them safely, but even the most lovingly prepared parcel, things can happen. If you send these products back to us within 14 days of receiving them, we will offer you an exchange where possible, or a full refund after we have received the return. Please ship back with a proof of sending.

In this case, we will pay for the postage of sending these items back to us. Nothing in these Terms and Conditions affects your statutory rights.

  • Personal information

We will only use your personal information as set out in our Privacy Policy.

  • Price and Payment

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Payment for all Products must be by credit or debit card. We accept various types of payments with Paypal, American Express, Visa, Visa debit cards, MasterCard and others. We reserve the right to change the payment methods we accept at any time.

Credit card information is always encrypted during transfer over networks.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

TAXES & DUTIES

Import taxes, duties and related customs fees may be charged once the parcel arrives at the destination country. These charges are determined by the customs office of the specific destination.

Payment of these charges and taxes is the responsibility of the recipient and will not be covered by us here at BelledeSoiree. For further details of the charges, please contact your local customs office.

CUSTOMS & REGULATIONS

You are responsible for checking your local postal regulations for restricted items, as we cannot be held liable for any items that are not accepted into the specific country.

Warranty/PRODUCTS OR SERVICES (if applicable)

In accordance with our product policy, we warrant to our Client that our products are fully compliant with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations. However, we do use our best efforts so that the quality does meet your expectations and you can contact us at any time should you have any questions.

If we fail to comply with these terms and conditions we shall only be liable to you for, at most, the purchase price of the Products.

Nothing in this agreement excludes or limits our liability for any matter for which it would be illegal for us to exclude or attempt to exclude our liability. 

  • Written Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website.

For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to us must be given to BelledeSoiree at contact@belledesoiree.com

We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified herein. 

Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or on the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail that such e-mail was sent to the specified e-mail address of the addressee.

  • Transfer of Rights and Obligations

The contract between you and us is binding on you and us and on our respective successors and assignees.

You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

  • Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our site, whether registered or unregistered and in the material published on it. Copyright laws protect these works and all such rights are reserved.

You may print off one copy and may download extracts of any pages from our site for your personal reference. You must not use any part of our copyright materials for commercial purposes without first obtaining a license to do so from our licensors and us.

If you post comments on the products to any website, blog or social media network (Commentary) you must ensure that such Commentary represents your fairly-held opinions. By subscribing to the Services, you irrevocably authorize us to quote from your Commentary on our Site and in any advertising or social media outlets which we may create or contribute to.

  • Events Outside Our Control

We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

  • Strikes, lock-outs or other industrial¬†action;
  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for¬†war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural¬†disasters;
  • The Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private¬†transport;
  • The impossibility of the use of public or private telecommunications networks;¬†and
  • The acts, decrees, legislation, regulations or restrictions of any¬†government.

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

  • Waiver

If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

A waiver by us of any default will not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with this agreement.

  • Severability

If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

  • Entire Agreement

These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any Contract.

We each acknowledge that, in entering into a Contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.

Each of us agrees that our only liability in respect of those representations and warranties that are set out in this agreement (whether made innocently or negligently) will be for breach of contract.

Nothing in this clause limits or excludes any liability for fraud.

  • Our Right to Vary These Terms and Conditions

We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. BelledeSoiree shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any services that have been ordered on this website.

You agree to indemnify us and our agents, officers, directors, and employees immediately and on demand, against all claims, liability, damages, costs, and expenses, including legal fees, arising out of any breach of any of our terms and conditions.

No liability will be accepted by BelledeSoiree for any failure or delay in delivery wholly or partially due to an Act of God, War, Fire, Explosion, Riot, Civil Commotion, Restriction by Government or the competent authority, Strikes, Lock Outs, Failure in Supplies or any cause beyond our control.

  • USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.
